Alternative Dispute Resolution Options for Commercial Disputes
The courts are not the only option for solving disputes. There are other cost-effective and equally efficient means for resolving conflicts, such as Alternative Dispute Resolution (ADR) strategies. Sometimes, the courts advise parties to attempt ADR before filing a suit. In commercial disputes, it’s possible to seek ADR.
ADR strategies (negotiation, mediation, arbitration) can lead to win-win scenarios, unlike the litigation route, which leans toward the winner-take-all. ADR strategies favor settlement and compromise, often resulting in a fair and reasonable outcome for all parties. As such, only 5 percent of all commercial disputes are resolved via trial in litigation.
